1. Agreement to Terms
By accessing or using Ivy Interactive Video Editor ("the Service"), operated by Ivy Interactive Video Editor ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
The Service is a cloud-based interactive video editor that allows you to create, edit, and publish interactive video content through your web browser.

For legal purposes, references to "Ivy", "we", "us", or "our" refer to the operator of the Service.
3. Account Registration
To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to:
- Provide accurate and complete registration information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be at least 16 years of age to create an account
We reserve the right to suspend or terminate accounts that violate these terms or that have been inactive for an extended period. We may suspend or terminate your access immediately if you violate these Terms, use the Service unlawfully, or abuse the platform. Upon termination, your right to use the Service ceases immediately. Data may be deleted in accordance with our data retention policy.
4. Subscription Plans and Billing
4.1 Free Trial
New accounts receive a 7-day free trial with limited features, including a maximum of 2 projects and 500 MB of storage. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.
4.2 Paid Subscriptions
The Service offers multiple subscription tiers (Starter, Plus, and Pro) with varying feature limits, project quotas, and storage allocations. Current pricing and plan details are available on our website.
4.3 Payment Processing
All payments are processed securely through Paddle, our authorized payment provider. By subscribing to a paid plan, you agree to Paddle's Terms of Use and Privacy Policy. Paddle acts as the Merchant of Record for all transactions.
Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected billing cycle). Your payment method will be charged automatically at the beginning of each billing period.
4.4 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
If you believe you are entitled to a refund due to a technical issue or billing error, please contact our support team within 14 days of the charge.
4.5 Plan Changes
You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of the current billing period. Downgrades take effect at the start of the next billing period.
5. Your Content
5.1 Ownership
You retain full ownership of all content you upload, create, or publish through the Service, including videos, images, text, quizzes, and interactive elements ("Your Content"). We do not claim any intellectual property rights over Your Content.
5.2 License to Us
By uploading content to the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account.
5.3 Content Restrictions
You agree not to upload, create, or distribute content that:
- Infringes on any third party's intellectual property or proprietary rights
- Contains unlawful, defamatory, obscene, or harmful material
- Includes malware, viruses, or other malicious code
- Violates any applicable laws or regulations
- Impersonates another person or entity
We reserve the right to remove content that violates these restrictions without prior notice.
5.4 Content Backup
While we take reasonable precautions to protect Your Content, you are responsible for maintaining your own backups. We are not liable for any loss or corruption of Your Content.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or its infrastructure
- Use automated tools or scripts to access the Service without our prior written consent
- Resell, sublicense, or redistribute the Service without authorization
- Circumvent any usage limits, access controls, or security measures
7. Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by Ivy Interactive Video Editor and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
The Ivy name, logo, and all related marks are trademarks of Ivy Interactive Video Editor. You may not use these marks without our prior written consent.
8. Service Availability and Modifications
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice before making significant changes that affect your use of the Service.
9. Data Deletion and Account Closure
You may delete your account at any time through your account settings. Upon account deletion:
- Your profile and personal data will be permanently removed
- Your projects and uploaded assets will be permanently deleted
- Any active subscriptions will be cancelled
Deleted projects are retained for 30 days before permanent deletion, allowing you to restore them if you change your mind. After 30 days, deletion is irreversible.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, availability, or fitness of the Service for any particular purpose. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, Ivy Interactive Video Editor and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ivy Interactive Video Editor from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.
13. Governing Law
These Terms are governed by the laws of Morocco, without regard to conflict of law principles. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration. If arbitration is not enforceable in your jurisdiction, disputes shall be resolved by the competent courts of Morocco.
14. Force Majeure
We are not liable for any failure or delay resulting from events beyond our reasonable control, including infrastructure failures, network outages, acts of government, natural events, or failures of third-party service providers.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
